Hereinafter referred to as the “Operator”, “Company”, “FunkyMEDIA”, “we”, “us” or “our”.

  1. Any person who accesses or uses the Website is referred to as the “User”.
  2. By using the Website, the User confirms that they have read these Terms of Use and agrees to comply with them.
  3. If the User does not accept these Terms of Use, they should stop using the Website.
  4. The Website is primarily intended to provide information about FunkyMEDIA, AI Search, brand visibility in artificial intelligence systems and the professional services offered by the Company.
  5. The Website does not constitute an online store. No service can be purchased or paid for directly through the Website.

2. Definitions

For the purposes of these Terms of Use:

  2. Operator means BIGTECH IT sp. z o.o., which operates and administers the Website under the FunkyMEDIA brand.

  5. Contact Form means the electronic form that enables the User to submit an inquiry to the Operator.
  6. AI Search means systems and functionalities that use artificial intelligence to generate, summarise, select or present information, including services such as ChatGPT, Google AI Overviews, Google Gemini, Microsoft Copilot, Perplexity and similar platforms.
  7. Services means the professional consulting, analytical, content, technical, digital PR, SEO, brand mentions and AI Search services described on the Website. The detailed scope of any paid Services is agreed separately with the client.

3. Scope and Purpose of the Website

  1. The Website provides information concerning, in particular:a. AI Search strategy and optimization;b. brand visibility in AI-generated answers;c. AI visibility audits;d. competitor and market analysis;e. brand entity and source analysis;f. content strategy and implementation;g. digital PR and brand mentions;h. monitoring of visibility across AI platforms;i. search engine optimization and related digital marketing services;j. the professional experience and publications of FunkyMEDIA and its experts.
  2. Content published on the Website is provided for general informational and marketing purposes.
  3. Information presented on the Website does not constitute a binding commercial offer within the meaning of applicable law unless expressly stated otherwise.
  4. The presentation of a service, process, method or expected outcome on the Website does not create an obligation for the Operator to provide that service to every User.
  5. The detailed scope, schedule, price, responsibilities and conditions of cooperation are determined separately in an individual proposal, order, statement of work or agreement concluded with the client.

  5. Submitting the Contact Form does not:a. conclude a contract for paid Services;b. constitute an order;c. oblige the Operator to accept the inquiry;d. guarantee that cooperation will commence;e. reserve a project date or service availability.

  7. The User may terminate the use of any free electronic service at any time by closing the Website, leaving the relevant page or discontinuing completion of the Contact Form.

  4. The Operator does not control the final responses generated by ChatGPT, Google AI Overviews, Gemini, Copilot, Perplexity or any other third-party platform.
  5. Unless expressly agreed otherwise in a separate written agreement, the Operator does not guarantee:a. that a brand will be mentioned, cited or recommended by an AI system;b. a particular position, wording, frequency or context of a brand mention;c. the inclusion of a particular website or source in an AI-generated answer;d. specific search engine rankings;e. a specific volume of traffic, leads, sales or revenue;f. the permanence of any achieved visibility;g. identical results across different users, locations, languages, devices or platforms.
  6. Any examples, case studies, projections or descriptions of potential outcomes are illustrative and do not guarantee that the same results will be achieved in another project.
  7. The results of AI Search activities depend on many factors, including competition, market conditions, existing brand authority, the availability of credible sources, implementation speed and decisions made by independent platforms.

8. Informational Nature of Content
